1 SCOPE OF VALIDITY
The present General Terms and Conditions (hereinafter also referred to as T&Cs) contain the conditions exclusively applicable between you (hereinafter referred to as “customer”) and Noureddine Elhammouri (Hardstrasse 27, 5430 Wettingen) as the organizer for the implementation of cooking classes. All provisions apply unless otherwise agreed in the individual agreement.
2 CONCLUSIONS OF CONTRACT AND TERMS OF PAYMENT
1. For organizational reasons, registration for a cooking class can only be made using the registration form on the homepage www.kocheria.ch or “www.eventkuechebaden.ch” or www.cookithome.ch, by sending an email to the address info@cookithome.ch or a written message on the number 079 552 85 55. The customer receives a confirmation, the invoice for the course fee, and the general T&Cs. With the payment of the course fee by the customer, the contract is concluded. The terms and conditions can be viewed at any time on our website “www.cookithome.ch”.
2. Our prices are in Swiss francs. For organizational reasons, the course fee must be paid in full within 10 days after the order confirmation and invoice have been sent. The course fee can also be paid through our website “www.cookithome.ch” with the preferred payment method.
3 SERVICES
1. Nour Elhammouri offers cooking classes that are all about cooking, learning, and enjoying.
The services are provided in accordance with the applicable course program.
2. The course fees for the cooking course include all dishes that are prepared under professional guidance and the use of all cooking utensils. The price does not include alcoholic beverages such as red and white wine. However, these can be purchased on-site if required (wine accompaniment for dinner).3. The cooking courses take place in Kocheria (Hohlstrasse 365 8004 Zurich) or the Eventküche Baden (Bruggerstrasse 37, 5400 Baden). The current cooking courses can be found on our homepage www.kocheria.ch or “www.eventkuechebaden.ch” or www.cookithome.ch. The starting times, the scope of services, and the course fees for the cooking courses can be found in the applicable course program. Usually, the duration of a course is about 3.5 hours. The minimum number of participants per course is 6 people. The maximum number of participants per course is 12 people.
4 GIFT CARDS
1. Gift cards must be purchased for a specific date. However, it is possible to change the date of the course, when contacting us via E-Mail or phone.
2. Our cancellation policy also applies to classes booked through a gift card. If there is a no-show in a booked cooking class – there are no refunds. The gift card is just valid for the booked cooking class and expires after the date of the booked cooking class when not priorly postponed.
5 CHANGES IN SERVICES AND CANCELLATIONS BY THE ORGANIZER
1. If the minimum number of participants of 6 persons is not reached, the organizer reserves the right to combine courses up to 5 days before the start of the course, to postpone courses, or to cancel courses at his own discretion, with a full refund of the course fee already paid. Other claims of the course participants are excluded.
2. In case of impossibility to perform the course because the instructor is ill and cannot perform the course and no substitute person is available, Noureddine has the right to withdraw from the contract even at short notice against repayment of the course fee.
3. There is an immediate notification either through telephone or written if the desired course must be postponed or canceled.
6 CANCELLATION / PARTIAL CANCELLATIONS ON THE PART OF THE CUSTOMER
1.Noureddine must be notified in writing (by mail or e-mail) of any partial cancellation or full cancellation.
2. In case of cancellation by the customer up to 30 days before the start of the course, 25% of the course fee is due. In case of cancellation by the customer less than 14 days before the start of the course, 50% of the course fee will be charged. In case of cancellation of participation on the part of the customer less than 13 to 2 days before the beginning of the course, 75% of the course fee will be due. In the event of cancellation of participation on the part of the customer less than 24 hours prior to the start of the course or in the event of a no-show, this claim will be forfeited. The transferability of the participation to a third person remains unaffected; the customer has the right to transfer his participation to another person at any time.
3. In case of cancellation more than 30 days before the start of the course a service fee of 20 CHF per booking is due.
7 LIABILITY
Any liability in connection with our offer of the cooking course, as far as the law allows, is excluded. In particular, no liability is accepted for accidents related to sharp objects such as knives or potentially dangerous items. The customer acknowledges these conditions and accepts the risks of a kitchen environment when paying the full amount for a course or event. No liability is accepted for the thievery of personal items before, during, or after the cooking class.
8 HYGIENE
Every customer is obliged to follow all instructions of the course management regarding the hygienic handling of food and general hygiene. Allergies as well as contagious diseases must be reported to the course instructor before the start of the course. The course instructor reserves the right to exclude participants with contagious diseases from the preparation.
9 PRIVACY POLICY
Protecting the privacy of our customers is very important to us. The customer data will only be used for the registration to the cooking course and will not be disclosed to third parties. By registering for a cooking course, the customer gives his consent to contact him via e-mail and/or telephone in regard to his registration. For the payment, we do not store personal payment information. For the payment, the T&Cs of the company “www.zahls.ch” apply.
We use Google Analytics to track more details about how this website is used. We can analyze the IP address, type of browser, date/time, pages visited, amount of clicks, referring pages, exit pages, and other information that is not personally identifiable.
10 APPLICABLE LAW AND PLACE OF JURISDICTION
All legal relationships are subject to Swiss law. The place of jurisdiction for all legal disputes shall be
